1. Agreement and purchase record
A purchase is completed only after the buyer and n9007314 agree in writing on the selected artwork, buyer identity, permitted music project, price, and payment. A separate transaction confirmation signed electronically by n9007314, together with these terms, forms the complete cover-art license. Payments are accepted through the designated n9007314 Cash App Account. The buyer must be at least 18 years old or have a parent or legal guardian approve the purchase.
2. Copyright ownership
n9007314 retains authorship and copyright ownership of the artwork. Purchasing the digital file does not transfer the copyright, source materials, or any rights other than the limited exclusive license stated below. The license is included in the purchase price and does not require continuing royalties.
3. Exclusive cover-art license
After full payment and written confirmation, the buyer receives an exclusive, worldwide, continuing unless terminated under these terms or applicable law, license to use the artwork solely as cover art for the one artist and music project identified in the transaction confirmation. n9007314 will mark the listing sold and will not license that artwork to another customer for cover-art use.
The buyer may use the artwork:
- As the project cover on streaming and download platforms.
- On physical releases of that project.
- In social posts, advertisements, videos, and press materials promoting that project.
- After reasonable resizing, cropping, file-format conversion, or addition of artist and project text, provided those changes do not materially alter or replace major visual elements.
Recoloring or repainting the artwork, removing or replacing major visual elements, compositing it into substantially different artwork, and using generative AI to edit, modify, or transform it require prior written permission. Merchandise, unrelated projects, and other uses outside this section also require prior written permission.
The buyer may provide copies of the artwork to music distributors, streaming and download platforms, record labels, physical-media manufacturers, printers, video editors, designers, contractors, advertising platforms, and similar service providers solely as necessary to release, manufacture, distribute, or promote the permitted music project. Those providers may use the artwork only to perform services for that project and receive no independent right to use, retain, sell, license, or distribute it for any other purpose.
4. Reserved portfolio rights
n9007314 may identify the work as part of their portfolio and display a preview on personal websites, social accounts, exhibitions, and promotional materials. n9007314 will not sell or license the artwork to another customer in a way that conflicts with the buyer's exclusive cover-art use.
5. Prohibited uses
The buyer may not, directly or through another person:
- Resell, sublicense, rent, or transfer the artwork or license.
- Give away, share, leak, or distribute the standalone artwork, master file, or source materials.
- Upload the artwork to stock-asset, template, resale, or file-sharing services.
- Claim authorship or remove embedded ownership or rights information.
- Use the artwork for another artist, release, business, product, or project.
- Mint, tokenize, or sell the artwork as an NFT or similar digital asset.
- Recolor or repaint the artwork, remove or replace major visual elements, composite it into substantially different artwork, or otherwise create a materially altered or derivative version without prior written permission.
- Use the artwork as training or fine-tuning material for a generative AI or machine-learning model, or include it in a dataset intended for that training or fine-tuning.
- Upload, submit, or provide the artwork to a generative-AI tool or service for image generation, editing, transformation, style imitation, or creation of derivative artwork without prior written permission.
Distribution of the artwork as an integrated part of the permitted music project is allowed and is not prohibited standalone redistribution. Providing copies to the service providers identified in Section 3 solely as necessary for the permitted music project is also allowed and is not a sublicense or prohibited sharing.
6. Delivery
Final unwatermarked files are delivered through the method confirmed with the buyer after payment. The buyer is responsible for safely storing delivered files and confirming that the delivery can be opened. Preview images displayed in the store are not the licensed master files.
7. Refund policy — 48 hours
A buyer may request a refund within 48 hours after payment by messaging @n9007314x on Instagramwith enough information to identify the transaction. Refund requests received within that period will be honored through the original Cash App transaction.
Once a refund is issued, the license ends immediately. The buyer must stop every use of the artwork and permanently delete all delivered files and copies. Requests received after 48 hours are not eligible under this voluntary policy, except where applicable law requires a different remedy. This policy does not limit rights that cannot legally be waived.
8. Breach and termination
The license terminates if the buyer materially violates these terms and does not promptly correct the violation after notice. Upon termination, the buyer must stop using the artwork and delete all supplied files. Termination does not prevent n9007314 from pursuing available remedies for unauthorized use.
9. Responsibility and mandatory rights
The buyer is responsible for the music, text, trademarks, and other material combined with the artwork. The artwork is supplied for the agreed project and format. Nothing in these terms excludes warranties, refund rights, or other consumer protections that applicable law does not allow the parties to waive.
10. Pennsylvania law and changes
These terms are governed by the laws of the Commonwealth of Pennsylvania and applicable United States federal law, without limiting mandatory protections available in a buyer's location. The version accepted when a purchase is completed governs that transaction. Later website updates do not rewrite an existing sale.
